Sassari, student appeals to TAR: «Only 100 in the final exam, I deserved honors»

Praise be to those who deserve it. Or, as in the case of a former student of the scientific high school “Giovanni Spano” in Sassari, be sure to be up to it.
So much so that he appealed to the TAR of Sardinia against the Ministry of Education and Merit once he saw the results of the 2023/24 school leaving exam. Which saw him awarded "only" with 100/100 but without honors and, moreover, without any explanations being provided in the documents for that lack .
As he writes in the request, the provision is guilty of "manifest illogicality and unreasonableness" and, on the other hand, according to him, the results obtained with the studies and in the final exam itself spoke clearly: "The appellant had all the requirements for the attribution of honors."
This would be confirmed by the "excellent results of the interview" and the written tests carried out with the commission which, however, denies that title, walling up in silence the reasons for that decision which, for the appellant, is an evident injustice. At this point, between the appellant and the court, the challenge of the sentences comes into play since, if the TAR Campania and Calabria in 2019 and 2024 considered the motivation necessary, other panels expressed the opposite: the praise is motivated only if conferred.
And the TAR of Sardinia is inspired by this orientation with lapidary sentences : «The motivational obligation in question cannot be configured if the candidate, despite having obtained the maximum score and satisfied the requirements set out in the aforementioned reference discipline, has not shown qualities deserving of that particular praise of which the awarding of honours constitutes an expression».
Translated into cash, you are good but not good enough to win that longed-for "more". The Court has thus rejected, in recent days, the appeal of the student who will have to settle for 100/100 , a grade that, it is likely, would provoke the envy of a good part of Italian students.
