"It stops the necessary recurrence of the relationship of trust": it is on this requirement that the appeal to the TAR hinges, which brings to light the conflict for the position of general director of Territorial Urban Planning and Building Supervision, which is the responsibility of the Department of Urban Planning of the Region.

To clarify immediately: the Administrative Court declared itself incompetent to decide and sent the case back to the Civil Court. But the elements of the case are clear and make it clear what the atmosphere is in certain departments.

The one challenging the expression of interest published in May 2024 is Maria Ersilia Lai, a regional director with an indefinite term contract. The counterparts are the Region and Antonio Sanna, who in June of the same year had received the assignment with a resolution of the Council: the choice had fallen on him.

Lai did not contest the assignment of the role. But the criteria that would have determined it. After a series of professional and career requirements, the announcement emphasized the procedure would not lead to any ranking and that "among the subjects in possession of the requirements (...) the assessor of Local Authorities, Finance and Urban Planning" would proceed "to the identification of the candidate to propose for the assignment of the role, without prejudice to the necessary recurrence of the relationship of trust". Lai, relying on the lawyer Giovanni Maria Lauro, has targeted this last step, because "the importance attributed to the relationship of trust existing between the Regional Council and the candidates" would be "a criterion that would illegitimately penalize their professionalism and is not contemplated by the relevant regulatory discipline". How it will end will be decided by the ordinary Court, if the case is not abandoned.
